Hourly billing is the normal and customary way attorneys bill for their services. In January of 2009, I decided to try something different and switched to Value Pricing.
Value Pricing is an alternative to hourly billing. The basic premise of Value Pricing is that the attorney and client arrive at a customized, fixed fee for specific services prior to undertaking the representation. For example, in a contested divorce action, we might divide the litigation into three phases, such as the Initiation Phase where we get the litigation started, the Discovery Phase where we learn about the opposing party's evidence, and the Trial Phase where we prepare for trial and, if necessary, proceed to trial. For each phase of the litigation, there would be a set price for attorneys fees to be paid at the beginning of that phase of the litigation.
Value pricing allows the client to know up front the maximum amount he or she might have to pay in attorneys fees, and it provides incentive for the attorney to handle the matter with greater efficiency.
